01 · What it is
Two parts
of the same home.
A home can be split into two parts. The usufruct (usufruto) is the right to live in the home and use it. The bare ownership (nua propriedade) is the ownership of the home without that right.
In a sale with usufruct, you sell the bare ownership and keep the usufruct. You go on living in your home as always. When the usufruct ends, at the end of life, the home becomes fully the buyer’s.
It is a contract set out in the Portuguese Civil Code. It is signed as a public deed, and your right is registered at the Land Registry, which protects it against anyone.

04 · What it is worth
Age
matters.
The more years of usufruct are expected, the larger the part you keep and the smaller the part you sell. Portuguese law has a table for this. Try it.

Figures from the tax table in article 13 of the IMT Code, for a usufruct held by one person. They are not an offer. The amount offered depends on the home, the market and the agreed terms, and is usually below this tax value. If the usufruct is held by two people, the calculation is different.

Who pays
for what.
Living in the home
You keep using the home as always. You can have family over and carry on with your life.
IMI, condominium and small repairs
By law, these fall to whoever holds the usufruct. Our offer states in writing who pays each cost, so there is no doubt.
Structural work
Extraordinary repairs, such as the roof or the structure, fall to the owner of the bare ownership.
Deed and purchase taxes
The IMT and stamp duty on the purchase are paid by the buyer.
06 · Questions
What every family
wants to know.
What about my children? What do they inherit?
They inherit the money you received and did not spend, and everything else that is yours. The home is not part of the estate, because it was sold.
They do not inherit any debt either: a sale with usufruct is not a loan.
Can anyone make me leave my home?
No. The usufruct is your right, signed by deed and registered. The buyer cannot use the home or ask you to leave while the usufruct exists.
What about my husband or wife?
The usufruct can be held by both of you. It then only ends when the last person’s ends. The value is calculated differently, and we explain how.
What if one day I need to move to a care home?
The usufruct is still yours. You could, for example, rent the home out and keep the rent. You can also agree with the buyer to end the usufruct early, in exchange for a payment.
How is this different from a reverse mortgage?
A reverse mortgage is a loan secured on the home, which your heirs must repay. In a sale with usufruct there is no loan and no debt. There is a sale.
Do I pay tax on the money I receive?
There may be capital gains tax, depending on your case. We explain what we know and recommend you confirm with an accountant before signing.
